Terms of Use
This Agreement (the Agreement) governs your use of the Torontoraves.com
message posting boards (the Board). In consideration of your right to access
and use the Board, you and the editorial Board of Torontoraves.com (TR) agree
as follows:
Usage of the Board signals your agreement to be bound by the terms of this Agreement and any modifications made to it in accordance to Section 6 below.
You understand and agree that the Services is provided “AS-IS” and that TORONTORAVES.COM assumes no responsibly for, among other things, (1) any services outages or interruptions (2) the unavailability of particular Boards, features of services, (3) the inability to access the Service, (4) the failure or inability to post materials to the Service, (4) the deletion of materials posted to the Service or (5) the failure to store materials posted to the service.
You agree to NOT use the Board to:
(a) Violate or solicit the violation of any applicable local, provincial, national or international law.
(b) Upload or post any Content that is (1) unlawful, threatening, abusive, tortuous, defamatory, obscene, libelous, or invasive of another's privacy; (2) constitutes pornography, or sexual material of an obscene nature or that violates local, state, or national laws; (3) is the private information of another, such as their addresses, phone number, Social Insurance Number, or credit card number.
(c) Spam the Board.
You agree to:
(d) Assist Moderators in enforcing User Conduct by contacting Moderators or Administrators through any means i.e.: e-mail or instant messaging.
(e) Avoid discussions regarding drug purchase, availability, and usage in accordance with Section 3(a)
* Discussions regarding Drug Education and Harm Reduction are excluded from this provision.
(f) Abstain from utilizing the Board for advertisement without prior consent from TorontoRaves.com; event postings in the appropriate forum are excluded from this provision.
(g) Signature limitations are: 300 Characters and a image no greatter than 468 x 60 in size.
As a Moderator, you agree to:
(a) Uphold the vision of the editorial board of TorontoRaves.com and act in accordance to this vision.
(b) Ensure User Conduct is being followed and respond to User concerns regarding conduct on the Board expeditiously
(c) Facilitate an open environment permitting discussions to occur with minimal interference. If a Moderator does not uphold Conduct appropriately, the administration of TorontoRaves.com may, at its sole discretion, may terminate your Moderator status.
You are solely responsible for your interactions with other users of the Board. TorontoRaves.com reserves the right, but has no obligation to monitor, moderate, edit and/or delete disputes between you and other users of the Board.
TorontoRaves.com reserves the right at any time, and from time to time, to modify or discontinue, temporarily or permanently, the Board with or without notice. You agree that TorontoRaves.com shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.
You agree that Torontraves.com, in its sole discretion, may terminate
your account (or any part of it) or ability to use the Service, and remove and
discard any Content within the Board, for any reason, or for no reason,
including, without limitation, for lack of use, or for violating the letter or
the spirit of this Agreement. You agree that any termination of your access to
the service may be immediate and without prior notice. You further agree that
TorontoRaves.com shall not be liable to you or any third-party for any
termination of your use or ability to access the Board.
All content posted to the Board becomes the property of TorontoRaves.com, other then Content to which you hold the intellectual rights. You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, use of the Board, access to the Board or any of the Content accessible through the Board, other then Content as to which you hold the intellectual property rights. You agree that TorontoRaves.com may, at it's sole discretion, reproduce, duplicate, copy, resell or exploit all content to which you do not hold the intellectual rights.
We may amend this agreement at any time by posting the amended terms on our site. All amendments shall be immediately effective. Your use of the Board following the posting of any modifications shall constitute your binding acceptance of those modifications.
(a) TorontoRaves.com and/or any officers, directors, webmasters, employees, volunteers or partners of the company/site do not take responsibility for any comments, views, articles or other print that appears on, or is posted to, the Board forums. TorontoRaves.com and/or any , directors, webmasters, employees, volunteers or partners of the company/site do not take any responsibility for submissions, regardless of content. Periodic checks, moderating, editing and deleting does not constitute an accepted responsibility.
(b) TorontoRaves.com and/or any officers, directors, webmasters, employees, volunteers or partners of the company/site do not take any responsibility for the accuracy of events, reports, or other information found on the site.
(c)
No content from the Board may be reproduced for distribution/redistribution
for any reason in whole or in part without express prior written permission
from an officer or director of TorontoRaves.com
(d) At any time, at the sole discression of the Administration or Moderators of TorontoRaves.com, there may be a request to grab your ankles. TorontoRaves.com members are expected to comply.
You expressly understand and agree that TorontoRaves.com shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including (but not limited to) damages for loss of profits, goodwill, use, data or other intangible losses (even if TorontoRaves.com has been advised of such damage).
You agree to indemnify and hold Torontoraves.com, and its subsidiaries, affiliates, officers, agents, employee, and contractors harmless from any claim or demand, including reasonable attorney's fees, made by any third party due to or arising out of Content you submit, post to, or transmit through the Service or Board, your violation of the law, this Agreement, or the rights of another.
This Agreement constitutes the entire agreement between you and TorontoRaves.com with respect to the Board and supersedes all prior agreements and understandings between you and TorontoRaves.com. TorontoRaves.com's failure to enforce any provision of this agreement will not be construed as a waiver of any provision or right.
This agreement is developed in
English and English will be the official language of all correspondence with
TorontoRaves.com
